Terms and Conditions

Why SMASH? Because we handle everything.


These Terms and Conditions outline the agreement between The SMASH Agency (“we”, “us”, “our”) and you, the client. By engaging with our services, you agree to the following terms.


1. Our Promise To You

At The SMASH Agency, we aim to deliver creative brilliance, strategic clarity, and full-on operational support. We bring energy, experience, and a whole lot of action-taking power to your business. We’ll always act with your best interests in mind and treat your business as if it were our own.


2. What’s Included

Your bespoke support package will be tailored specifically for your business, but most packages may include:


  • Weekly team update calls 
  • Rolling quarterly planning sessions 
  • Day-to-day support via WhatsApp/Slack/Teams 
  • CRM setup and management 
  • Content creation (social media, email, campaign copy) 
  • Strategic advice 
  • Launch and event coverage 
  • Data tracking and reporting 
  • Lead generation activities
     

The scope of your package will be agreed in writing (usually email) and can evolve over time to meet your changing needs.


3. Fees & Payment Terms

  • Our retainers start from £1650 per month. 
  • Payment is due monthly in advance, by the 1st of each month, unless otherwise agreed. 
  • Invoices will be issued via email and must be paid within 7 calendar days. 
  • Late payments may result in a pause of services until payment is received.
     

All fees are subject to UK VAT where applicable.


4. Commitment & Notice

  • We work on a rolling 3-month minimum term unless otherwise stated
  • After that, we require 30 days’ written notice if you wish to pause or cancel services. 
  • If you’d like to scale up or down, just let us know – we’re flexible and happy to adjust where possible.
     

5. Your Commitment To Us

  • Please provide access to relevant systems, content, and brand materials in a timely fashion. 
  • Clear communication is key – we rely on your input, especially during planning and approvals. 
  • You agree not to share or reproduce any of our strategy documents, tools, or content with third parties without written permission.
     

6. Confidentiality

We treat all your business information and data as confidential. We won’t share or disclose anything without your permission unless legally required to do so.


7. Intellectual Property

  • All creative content we produce for your business (social posts, copywriting, designs, CRM flows, etc.) becomes yours upon full payment. 
  • Any tools, templates, systems, or training materials we provide remain our intellectual property and are licensed to you for use within your business only.
     

8. Project Changes & Additional Work

Need something extra? No problem! Additional work outside the agreed scope will be quoted and agreed before we begin. This might include event attendance, urgent last-minute campaigns, or additional strategy sessions.


9. Holidays & Downtime

We are a small but mighty team. If we are taking a short break or closing over holiday periods, you’ll be notified in advance, and plans will be made to ensure consistent support.


10. Cancellations & Refunds

Due to the time-based and strategic nature of our services, we do not offer refunds. If you’re unhappy, let’s talk – we’d much rather work together to fix the problem and keep things moving forward.


11. Liability

We are committed to excellence but cannot guarantee specific results or outcomes. While we take every reasonable care, we are not liable for any losses (direct or indirect) resulting from the use of our services.

Terms & Conditions – Crowdfunding Programme Access

By enrolling in this Crowdfunding Programme, you agree to the following Terms & Conditions. These are in place to protect the integrity of the programme, the investment of every participant, and the intellectual property of The SMASH Agency.

1. Lifetime Access

Your purchase grants you lifetime access to the core programme materials – including videos, checklists, guides, and templates – as they exist at the time of purchase. These materials may be updated and refined over time, and you will continue to receive access to any core updates made available within the same tier.

Please note: We reserve the right to introduce additional advanced levels or enhanced resources in the future which may be offered at an additional cost.

2. Intellectual Property & Content Use

All content provided within this programme is the exclusive property of The SMASH Agency. This includes, but is not limited to, all videos, tutorials, guides, checklists, templates, and recordings of live sessions.

By purchasing this programme, you agree that:

  • You will not copy, reproduce, share, teach, resell, or distribute any content, in whole or in part, without express written permission.
     
  • You will not pass on your login or any downloads to others, whether for free or for profit.
     
  • You will not adapt the programme materials for use in your own paid or free offerings, courses, or services.
     

Any breach of this clause is taken seriously and may result in immediate removal from the programme without refund. Legal action may also be taken in cases of infringement.

3. Single-User Licence

Access to the programme is provided to one individual per purchase. Sharing login details, downloads, or templates with others is not permitted. If additional members of your team wish to participate, separate licences must be purchased.

4. No Guarantee of Results

While this programme is based on tried-and-tested methods, no specific results or income levels can be guaranteed. Your success will depend on many factors, including your effort, commitment, timing, campaign idea, and marketing execution.

You acknowledge that:

  • This programme is educational in nature and is not a guarantee of crowdfunding success.
     
  • The SMASH Agency is not responsible for the outcome of your campaign.
     
  • The information provided does not constitute legal or financial advice.
     

5. Refunds

Due to the nature of digital delivery and instant access to programme materials, no refunds will be issued after purchase. Please ensure you are committed before joining.

6. Community Conduct & Participation

Respectful, constructive interaction is expected in all live Q&A calls and any programme-related community spaces. We reserve the right to remove anyone from the programme – without refund – for the following:

  • Breach of these Terms & Conditions
     
  • Disrespectful or disruptive behaviour
     
  • Attempting to solicit or poach clients within the group
     
  • Misuse of programme materials or content
     

7. Programme Updates & Access

We are committed to keeping this programme relevant and useful. As such:

  • Core content may be updated to reflect changes in crowdfunding trends or platform features.
     
  • You will retain access to the version of the programme you purchased, plus any relevant updates within the same tier.
     
  • Additional resources, advanced modules, or premium support levels may be released in the future and will be offered at an additional cost.
     

By purchasing and accessing this programme, you confirm that you have read, understood, and agreed to these Terms & Conditions.
